Website Use and General Terms & Conditions
Rockies website(s) ("our site”, "site”) and related services are made available to site visitors ("you”, "your”, "yours”) pursuant to the following Terms & Conditions (T&C), and any other rules posted on our sites. By visiting Rockies you are accepting the T&C. If you disagree with these terms, you must discontinue use of the site immediately.
Sales and Ordering
Items that you selected to purchase will appear in your Shopping Cart. Should you change your mind prior to check out and payment, you may edit your Shopping Cart accordingly.
When you check out we will verify your credit card, process payment and place the order. If you do not go through the checkout process your order will not be processed and your credit card will not be charged.
All orders will appear on the cardholder's statement under the name "Rockies Queenstown New Zealand".
Once your credit card payment has been processed and your address verified, you will receive an email confirming the details of the order.
We reserve the right not to accept your order in any event, for example, that we are unable to obtain authorisation for payment, that the item is out of stock or does not satisfy our quality control requirements. Furthermore, we may refuse to process a transaction for any reason or refuse service to any person at any time at our sole discretion.
We will not be liable to you, or any other third party for the withdrawal of any merchandise from the site whether or not that item has been sold; removing or editing any materials or content on the site or refusing to process a transaction after processing has begun.
Changing an Order
If you have made a mistake or would like to change an order you have just placed, please call us on +64 (0)3 442 8153 within 12 hours of the order. We will do everything we can to accommodate your request, however items that have already been sent will need to comply with our Returns Policy.
Gift Vouchers and Store Credits
Gift Vouchers must be redeemed within 12 months of the date of issue, after which they expire.
A gift voucher can only be redeemed by the recipient of that gift voucher as nominated by the purchaser. An account credit can only be used by the person whose account is credited with that store credit. The holder of the account credit and/or gift voucher cannot transfer or assign the account credit or gift voucher, or his/her rights under it.
A gift voucher or account credit cannot be assigned to an order that has already been placed. If the item(s) ordered are more than the value of the gift voucher or account credit, then the remaining balance must be paid for by the holder.
If the cost of the item is less than the value of the gift voucher or account credit, we will hold the remaining amount in the holder’s account.
Gift cards are like cash and are not replaceable.
Items on the website are priced in New Zealand dollars and are inclusive of GST. All prices and offers remain valid as advertised and are exclusive of delivery costs. Delivery charges (if applicable) will be added to your item(s) prior to payment.
Methods of Payment
Rockies accepts payment by Visa, MasterCard, Apple Pay, Alipay, Direct Credit, store credits or gift vouchers.
Payment will be taken from your account upon receipt of your order. All credit card holders are subject to validation checks and authorisation by the card issuer. If the card issuer refuses authorisation, we will not be liable for any non-delivery.
For overseas buyers, your credit card will be billed in New Zealand dollars and converted into the relevant currency by your financial institution. New Zealand GST is not charged on purchases sent to overseas addresses.
Some of our popular brands offer presales. This gives you the first choice of items at the release of a collection prior to the stock arriving in store.
If your order includes items in stock and presale, we will contact you and ask if you would like to wait and have all your items sent together when the presale stock arrives in store.
Presales are released based on what we have ordered from our suppliers (sometimes a year in advance) and at times they will be unable to deliver all items ordered. In this case, Rockies will be unable to fulfil your order. This is beyond our control and we will contact you to offer the next best option or a refund.
Presales can usually be seen on our website from 1-4 weeks before the stock arrives in store.
Please be aware that delays due to couriers or customs can arise. We will stay in touch with you about timeframes and will do everything we can to get your items out to you at the earliest possible opportunity.
Items are usually supplied by Rockies from stock. In certain situations we are able to take pre-orders for popular stock that is limited in supply and will sell out quickly. Rockies may require additional time to deliver these products, since at the time we offer them as pre-orders, they will not yet be in store. Our website will usually provide estimated delivery times. By providing us with your personal information, you authorise us to perform credit checks and, where necessary, to transmit or obtain information about you (including updated information) to or from any third parties from time to time, including but not limited to your credit card number or credit reports to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchases.
The onus is on the purchaser to supply the correct information to us. This includes name, address, telephone number(s), email addresses and credit card details.
Intellectual Property Rights
You acknowledge and agree that all copyright, designs, logos, trademarks and all other intellectual property and material rights relating to the content as herein described, including Rockies software and all HTML contained in this site, shall remain at all times vested in Rockies and/or are the property of its respective owners. You are permitted to use the content only as expressly authorised by Rockies and/or its third party licensors. Any reproduction or redistribution of the above listed content is prohibited and may result in criminal penalties. Violators will be prosecuted to the fullest extent permissible under applicable law.
In addition to the Intellectual Property Rights listed above, content is defined as any graphics, photographs including all image rights, sounds, music, video, audio or text on this site. Rockies tries to ensure that all content on this site is accurate and complete, however Rockies does not warrant or represent that the content is accurate, error free or reliable, or that your use of the website content will not infringe on the rights of third parties. Your use of the website is at your risk. Rockies does not warrant that functional aspects of the website content will be error free or that this website content or the server that makes it available be free of viruses or other harmful components. If your use of this website results in the need for replacing or servicing property, material, equipment or data, Rockies is not responsible for these costs.
No Commercial Use
This website is for your personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer or sell any content, software, products or services contained within this site. You may not use this site, or any of its content, to further any commercial purpose, including any advertising or revenue generating activity on your own site.
